Welcome to beViral. These Terms of Service ("Terms") govern your use of our mobile application operated by MOON VISION SOCIETY (MVS) (SIREN: 889 750 311, VAT: FR95889750311), located at 3 Rue Emmanuel Kant, 92150 Suresnes, France.

By downloading, installing, or using beViral, you agree to be bound by these Terms. If you do not agree, please do not use the app.

1. Service Description

beViral is a TikTok content optimization tool that helps creators discover trending content, analyze their profiles, and improve their viral potential. The app provides:

• Trending sounds and video recommendations
• Profile analysis and beViral score calculation
• Best posting time suggestions
• Content inspiration saving and organization
• Educational content through the Academy section

2. User Account

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You must be at least 13 years old to use this app.

You agree to provide accurate information and to update it as necessary. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscription & Payment

Free Trial: New users receive a 3-day free trial. You will not be charged during the trial period. You can cancel anytime before the trial ends to avoid being charged.

Auto-Renewal: Your subscription automatically renews unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

Manage Subscription: You can manage or cancel your subscription anytime through your Apple ID Account Settings. Go to Settings → [Your Name] → Subscriptions.

Refunds: Payment is processed through Apple. Refund requests must be made directly to Apple through their refund process.

Right of Withdrawal (EU): If you are a consumer in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day of the conclusion of the contract. To exercise this right, contact us or request a refund through Apple. If you begin using the service during the withdrawal period, you may lose this right.

4. Acceptable Use

You agree not to:

• Use the app for any illegal or unauthorized purpose
• Attempt to reverse engineer or extract source code
• Interfere with or disrupt the app's functionality
• Share your account credentials with others
• Use automated systems to access the app
• Violate any applicable laws or regulations

5. Intellectual Property

All content, features, and functionality of beViral are owned by MOON VISION SOCIETY (MVS) and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of your TikTok content. We only access publicly available data from your TikTok profile.

6. Disclaimers

beViral is provided "as is" without warranties of any kind. We do not guarantee:

• Specific results or viral success
• Accuracy of projections or recommendations
• Continuous, uninterrupted access to the service

We are not affiliated with or endorsed by TikTok. Trending data is based on publicly available information and may not reflect real-time TikTok metrics.

7. Limitation of Liability

To the maximum extent permitted by law, MOON VISION SOCIETY (MVS) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app.

Our total liability shall not exceed the amount you paid for the subscription in the 12 months preceding the claim.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the app or by email. Continued use of the app after changes constitutes acceptance of the new Terms.

9. Governing Law

These Terms are governed by the laws of France. Any disputes shall be resolved in the courts of Paris, France.

10. Termination

You may terminate your account at any time by cancelling your subscription and deleting the app. We may terminate or suspend your account for violations of these Terms.

Upon termination, your right to use the app ceases immediately. We may retain certain data as required by law.
